FCA Supervision and Enforcement Approach

The FCA has set out its approach to supervision and enforcement in a number of documents, further to its earlier publication of its Mission, explaining its Regulatory approach.

The FCA has set out its approach to supervision and enforcement in a number of documents, further to its earlier publication of its Mission, explaining its Regulatory approach.

In its latest documents, the Regulator considers supervision as ‘the continuing oversight of firms and of individuals controlling firms to reduce actual and potential harm to consumers and markets’. The Supervision document includes the FCA’s supervisory principles, priorities and focus and ‘supervision in practice’ covering identification of harm, diagnostic tools, remedy tools and evaluation.

Its enforcement document describes the Regulator’s conduct of investigations and its powers, including how it identifies harm, diagnosing harm through its investigations, sanctions and remedies and evaluating its approach to enforcement and measuring performance.

Deadline for comments on both documents is 21 June 2018, with the final approach documents due to be published, before the end of 2018.
